By signing up for or using any services provided by Loomis Pet Waste Management ("Loomis," "we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Loomis Pet Waste Management provides professional pet waste removal services for residential and commercial properties in the Central Valley, California. Services include one-time cleanups, recurring scheduled visits (weekly, bi-weekly, or monthly), and optional add-on services such as Loomis FreshGuard odor elimination and sanitization treatment. The scope of each service visit is limited to pet waste removal from designated yard areas as agreed upon at the time of signup. Services are performed during normal business hours. Specific arrival times within scheduled service windows cannot be guaranteed.
You agree to provide safe, unobstructed access to your yard on your scheduled service day. This includes ensuring gates are unlocked and any hazards are removed prior to our arrival. If access is denied or unsafe at the time of the scheduled visit, the visit may be skipped without a refund or credit for that service. We will attempt to notify you in such cases. You are responsible for informing us of any changes to access conditions, gate codes, or yard configuration.
Our technicians are trained to work safely around pets. You acknowledge that by having pets present during service, you accept responsibility for the behavior of your animals. For the safety of our staff, we generally require that all dogs be secured indoors or in a contained area prior to our arrival, unless otherwise arranged with us in advance. If dogs are not secured upon our arrival and no prior arrangement has been made, the service visit will be skipped with no refund issued. Loomis Pet Waste Management reserves the right to skip a service visit if our technician believes the animals present pose a risk to their safety, without penalty to the company.
Our service operates on a prepaid, subscription-based billing model. A valid credit or debit card on file is required for all clients, whether receiving one-time or recurring service. Recurring clients are billed automatically at the start of each 4-week billing cycle (every 28 days from the date of first service). One-time cleanup fees are charged at the time of booking. All payments are processed securely through our payment processor. By providing your payment information, you authorize Loomis Pet Waste Management to charge the card on file for all applicable services and fees. If a payment fails, we reserve the right to pause service until payment is resolved. Overdue balances may result in service suspension. New clients who sign up for recurring service but cancel before their second scheduled service, or whose service is terminated due to a violation of these Terms, will be reclassified as a one-time cleanup and charged at the one-time cleanup rate of $129. Any difference between the recurring rate already charged and $129 will be billed to the card on file.
You may cancel your recurring service at any time with no cancellation fees or penalties. We request at least 24–48 hours' notice prior to your next scheduled service date. All sales are final. We do not offer refunds for any services rendered or billing cycles already charged. Cancellations made after a billing cycle has begun will not receive a prorated refund for the remaining visits in that cycle. Unused visits within a paid cycle may be used up until the end of that billing period. In the event of severe weather, hazardous conditions, or unforeseen circumstances that prevent us from safely completing service, we will make reasonable efforts to reschedule the visit within the same billing cycle or provide a service credit. We are not liable for delays or missed visits caused by events outside our control, including but not limited to inclement weather, road closures, or acts of God.
Loomis Pet Waste Management takes care to treat your property respectfully. In the unlikely event that damage to your property is caused directly by our technician during a service visit, please notify us within 48 hours. We are not responsible for pre-existing damage, normal wear and tear, or issues related to gates, latches, fencing, or landscaping that are not directly caused by our staff.
To the maximum extent permitted by applicable law, Loomis Pet Waste Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services. Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you for services in the 30 days preceding the claim.
We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on our website at loomispetwaste.com. Continued use of our services following any changes constitutes your acceptance of the updated terms. We will make reasonable efforts to notify active clients of material changes via email or through the client portal.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Stanislaus County, California.
